Planning Matters

The laws governing planning are complex and planning consent is required before most forms of development can be legally undertaken.

Planning Application Pre-Consultation
Community Involvement in the Planning Process

As part of any formal submission, you should always identify what efforts you have made to seek comments and show how you have responded to them.  Chineham Parish Council welcomes consultations on planning applications prior to any formal planning application being made and information gathered from these consultations can be fed into proposals, and amendments can be considered to overcome concerns or make improvements.

Consultations can take a variety of forms and depending on the nature of the works proposed, the Parish Council recommends the following level of consultation:

Small Scale Domestic and Business Projects:

These are defined as extensions to houses, small business extensions and minor changes of use and advertisements on business premises.  These proposals will not have a wide impact but may affect immediate neighbours.

We believe that the appropriate level of consultation should be:

  • Send plans, sketches and photos of the site to the Parish Council;
  • Inform the Local Borough Councillors (note 1);
  • Inform immediate neighbours – this should include at least any property which shares the boundary of the property or faces the application property on the opposite side of the road;

For such proposals the Parish Council will:

  • Add the submission to the next available Parish Council Planning Committee meeting;
  • Give informal comments on the submission based on the material submitted;
  • Record the advice given and be aware of it when considering the formal planning application sent to us by the Borough Council.

Small to Medium Developments

These can normally be defined as planning applications for proposals of one to five dwellings or commercial and retail schemes of no more than 1000sq metres or under a site area of 0.5 hectares. 

We believe that the appropriate level of consultation should be:

  • Send plans and particulars, (location plan, site plan, elevations, proposed design and access statement ) and photos of the site to the Parish Council;
  • Inform the Local Borough Councillors (note 1);
  • Inform immediate neighbours in writing– this should include at least any property which shares the boundary of the property or faces the application property across the road;
  • Inform neighbours who live in the immediate street or area;
  • Consider if a public exhibition or meeting would help to collect comments;
  • Consider placing an advert in the local paper and, if timing allows, the parish magazine (Chineham Chat).

For such proposals the Parish Council will:

  • Advertise the submission in the published agenda for the relevant meeting;
  • Add the submission to the next available Parish Council Planning Committee meeting
  • Provide informal comments on the submission based on the material submitted
  • Record the advice given and be aware of it when considering the formal planning application sent to us by the Borough Council.

Large and Significant Developments

We believe that the appropriate level of consultation should be:

  • Send plans and particulars, (location plan, site plan, elevations, proposed design and access statement ) and photos of the site to the Parish Council and agree the date of the Parish Council Planning Committee meeting at which the submission would be considered;
  • Inform the Local Borough Councillors (note 1);
  • Inform neighbours in the wider area in writing– this would be within the immediate streets, where the development could be viewed from the wider area and where properties could consider that they would be affected by the development.  This should be carried out using a specifically prepared leaflet providing an invitation  to a public meeting and informing them of the agreed Parish Council Planning Committee meeting date;
  • Arrange a public exhibition or meeting;
  • Place an advert in the local paper or if timing allows, the Parish magazine (Chineham Chat).

For such proposals the Parish Council will:

  • Advertise the submission in the published agenda for the relevant meeting;
  • Add the submission to the agreed Parish Council Planning Committee meeting agenda;
  • Provide informal comments on the submission based on the material submitted;
  • Record the advice given and be aware of it when considering the formal planning application sent to us by the Borough Council.

Note 1 – Borough Councillors: 

It is important that Borough Councillors are kept informed of proposals in their area.  However, if they are asked to discuss or give their views on proposals they may decide not to do so because this could prevent them taking part in determining the subsequent planning application.  This is detailed in the Councils Code of Conduct and separate guidance titled ‘Code of Practice for officers and members dealing with Planning Matters’.  Both of these documents form part of the Constitution of the Borough Council and are available through the Borough Council’s website.
